And the truth is, some of the most expensive mistakes buyers make happen before they even get the keys.

Far too many waterfront offers are written with missing details, misunderstood terms, and assumptions that can turn into expensive problems later.

Not necessarily because it was the wrong property.
But because assumptions are not facts, and paperwork built on assumptions often leaves gaps.

Here are 7 important things to keep in mind while searching for your Muskoka cottage this season — plus a bonus tip at the end that has a little less to do with paperwork, and a little more to do with people.

1. Shore Road Allowance (SRA)

One of the biggest misconceptions in waterfront real estate?
Many buyers assume they own right to the water’s edge.

Sometimes, they don’t.

Ask:

  • Is the Shore Road Allowance owned, leased, or retained by the municipality?
  • Is it transferring with title to the property on closing?
  • Could it impact future dock permits or waterfront improvements?

Why it matters: Understanding the status of the Shore Road Allowance can impact how you’re allowed to use the shoreline, what improvements may be permitted, and future dock or waterfront applications.

2. Road Access

Not all cottage roads are maintained the same way.

Some are municipal.
Some are private.
Some rely on informal neighbour arrangements.

Ask:

  • Is the road year-round maintained?
  • Who pays for upkeep and snow removal?
  • Are there formal agreements in place?
  • If it’s an island property, does mainland parking and boat slip automatically transfer on closing?

Why it matters: Road access, parking, and docking arrangements are often assumed. Always get the details, costs, and agreements confirmed in writing.

3. Short-Term Rentals (STRs)

A lot of buyers today plan to offset ownership costs through rentals. But STR rules across Muskoka continue to evolve, and every Township has a unique process.

Ask:

  • Are short-term rentals permitted?
  • What kind of licensing is required?
  • What is the process to apply and be approved?
  • What are the timelines and costs involved?

Why it matters: Some properties work beautifully for STR use. Others prohibit it entirely. If this is a key decision making factor for you, know before you offer.

4. Docks & Waterfront Structures

Just because a dock exists doesn’t mean it was approved or has a permit.

The same goes for:

  • Boathouses
  • Shoreline decks
  • Other lakefront structures

Why it matters: Waterfront improvements without permits can affect future shoreline use and approvals, particularly when the Shore Road Allowance is not owned. Make sure the status of all waterfront structures is clearly understood.

5. Septic System

The least exciting, but a key component to the property.

Ask:

  • What is the age and size of the system?
  • Has it been recently inspected or pumped?
  • Does the Township have a re-inspection program in place?

Why it matters: Without clear answers, there could be costly repairs or even a replacement order from the Township. Request supporting documentation and understand the Township’s position on the system before moving forward.

6. Water Source

Where is the water coming from?

Ask:

  • Is the property serviced by lake water or a well (dug or drilled)?
  • Is the water line heated for year-round use?
  • Is there a UV filtration system for potability?

Why it matters: Some lenders require proof of potability. In competitive situations, water testing can also be covered as a term instead of a condition, helping keep an offer stronger while still protecting the option to obtain a clean water sample by closing.

7. Legal Access: Easements & Rights of Way

Do you have legal access to your cottage?

Ask:

  • Are there registered easements?
  • Are rights pedestrian only or vehicular too?
  • Is your access legally written into title or protected by title insurance.

You want to know about these deals in advance – not discover them post closing.

Pro Tip: If there’s any uncertainty, ask about requesting a title search before submitting your offer, or conducting one during your due diligence period. This step can clarify rights of access, uncover easements, and reveal details the seller may not even be aware of. It’s a smart step that can prevent surprises later.
